Fernie Wilderness & Nordica Contest: Cat Skiing Weekend Getaway for Two

1. ELIGIBILITY
Contest is open to all Canadian citizens (except residents of Quebec) who have reached 19 years old before March 15th, 2010. Employees, representatives and administrators of NRB Sports Inc., Fernie Wilderness Adventures and Park Place Lodge, their affiliated companies, representatives, agents, advertising and promotional agencies and their immediate family members and any person residing with them are not eligible to participate. No purchase is required to enter for a chance to win. The contest starts on November 6th 2009 and the final date for entry is March 15, 2010 *(at noon, Mountain Standard Time).

2. ENTRY
To enter, participants must fill out and submit their online registration form at www.powdercatskiing.ca . By entering the contest, participants agree to abide by the following rule: SUBMITTING AN ENTRY CONSTITUTES THE IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANSFERENCE TO THE ORGANIZER OF ALL RIGHTS, TITLE, INTEREST, AND ALL RESIDUAL INTERESTS REGARDING THE ENTRY, INCLUDING, WITHOUT LIMITATION, TO ALL COPYRIGHTS AND RENEWALS AND EXTENSIONS THEREOF.

3. RESTRICTIONS CONCERNING SUBMISSIONS
To be valid, names submitted must: (1) be intelligible and respect elementary rules of word formation; (2) not contain a trademark, company name or personal name; (3) not violate or transgress the rights of a third person, company, or entity, including, but not limited to the right to privacy, to advertising rights or intellectual property or copyright; (4) not have any indecent, obscene, profane, denigrating, hateful or defamatory connotation.

4. PRIZE
One (1) grand prize totaling $4310 will be awarded. Prize includes: two (2) nights lodging at the Park Place Lodge in Fernie (Deluxe double or Queen room), double occupancy upon availability (subject to blackout dates during holiday periods and high season), a value of $350; two (2) days of cat skiing for two (2) people, upon availability (depending on weather conditions, blackout dates apply), a value of $1800; two (2) pairs of Nordica Enforcer Skis with NPWR2S/XWB (115MM) bindings from the 2010-11 collection, a retail value of $2160. Prize excludes anything that is not described above. For example, flights, meals, gratuities, ground transportation, travel insurance, medical fees and other general charges covered by travel insurance, personal expenses, as well as all excursions and optional tourist visits or lift tickets at Fernie Resort.

5. GENERAL RULES
The contest winner is responsible for paying for and obtaining travel insurance. The winner and guest, who must also be of the age of majority, must have all valid pieces of identity (defined as what is valid by virtue of Canadian laws) at the moment of the draw. For example, in the case where the winner fails to have obtained the valid identity documents, no matter what the reason, he or she and guest will not be allowed to receive the prize. No prize will be awarded in its place.

The contest sponsor and/or their representatives reserve the right at all times and at their discretion to do the following: (a) apply reasonable restrictions on the availability or use of the prize or any aspect of the prize and (b) substitute the prize or any aspect of the prize, no matter what the reason, provided that the prize or any aspect of the prize substituted is of comparable value. The contest winner releases and holds harmless the contest sponsor and its affiliates if the services offered are not entirely satisfactory. The retail price of the prize is $4300 CAD. NRB SPORTS INC. (Nordica Canada) will award the prize and supply trip details to the winner once confirmed. In the case where the winner is not able to take the trip, and/or he/she and guest have not returned the Declaration and Release Form to the contest sponsor within the required 30-day limit, the winner renounces the whole prize and a new winner will be chosen from the eligible entrants. In addition, if the winner does not use all elements of the trip, this non-used element will be cancelled and nothing will be substituted in its place.

5.1 FERNIE WILDERNESS RULES
Fernie Wilderness Adventures is in the business of providing safe, fun and memorable wilderness experiences. Please remember, we have no control over weather, however, we must plan our trips and tours according to what the conditions dictate. This may mean that your planned activity may have a slight change to the schedule and/or area visited. These decisions are made by qualified and experienced personnel to ensure a quality and safe experience with the conditions available on that day. If Fernie Wilderness Adventures staff cancels an activity due to mechanical or safety reasons, you will be issued a rain check or carry out the planned activity another day. Guest cancellations or “no shows” due to illness, injury, weather, travel delays, etc. will NOT receive a refund. Please make sure you purchase travel/cancellation insurance prior to booking.

6. CLAIMING OF PRIZE
Draw will be made by an independent agency in Calgary on March 15th 2010 at noon (MST). The winner will
be contacted by phone. If after a 3rd attempt or 72 hours (3 days) the winner does not respond, another name will be drawn. The name of the winner will be posted on the contest Internet site as soon as confirmed in writing, or as soon as the prize has been accepted. To obtain the prize, winner must sign a Release Form which must be returned within 10 days following its reception otherwise the winner will be disqualified and another draw will be made. Once the winner has complied with the contest rules, he/she has until March 15, 2011 to use his or her prize; travel must be completed by March 15, 2011. Once reservations are confirmed, no change can be made to the guest or the date of travel chosen. If, for any reason, a modification or cancellation must be made, penalties may apply according to the specific rules of Fernie Wilderness and/or Park Place Lodge reservation rules. To claim the prize of 2 pairs of Nordica skis, the winner must contact Nordica Canada within 30 days from March 15th 2010 at 1-800-361-9090 ext 230. The Enforcer skis with NPWR2S XWB (115MM) bindings will be ordered from the 2010-11 collection therefore will be shipped to the winner in the fall of 2010.

7. PUBLICATION
By participating, contestants agree to be bound by the rules of the contest and the decisions of the independent organizers of the contest. In addition, contestants agree to allow, without compensation, for the use of their photos, videos and name of city or town of residence for publicity purposes on all advertising campaigns including the sponsor’s Internet website. Prize must be accepted as awarded and is non-transferable. No monetary value will be awarded in lieu of prize nor may the prize be sold, substituted or exchanged for another.

8. All decisions of the contest sponsor are final and binding. The contest is subject to all applicable federal, provincial and municipal laws.
